Compassionate Release Manual

Compassionate Release

The Samaritan Project prepares Compassionate Release (CR) and Reduction of Sentence (RIS) motions pursuant to 18 U.S.C. 3582(c)(1)(A). These motions go to the original sentencing court. Courts want to know what has happened since the original sentencing hearing (changed circumstances) that would warrant a reduction in sentence.

Sentencing Computation

The Samaritan Project prepares Sentencing Commutation pursuant to Article II, Section 2, Clause 1 of the United States Constitution which provides: The President … shall have Power to grant Reprieves and Pardons for Offenses against the United States.

Case Evaluations

The Samaritan Project prepares case evaluations. An evaluation allows us to ascertain for a small fee whether we believe we can ultimately help a particular inmate.

28 USC 2255 Motions

The Samaritan Projects prepares post-conviction motions pursuant to 28 USC 2255. A 2255 is a proceeding to vacate, set aside, or correct the criminal conviction and/or sentence. These motions generally involve numerous filings. We have 30 years experience preparing these motions and have successfully litigated hundreds of them.

Order and Send Transcripts

The Samaritan Project can obtain any transcript on PACER that is not sealed. We charge reasonable fees to obtain these documents and we send them to the institution legal mail.

Amendment 821

The Samaritan Project prepares United States Sentencing Guideline Amendment 821 motions pursuant to 18 USC 3582(c)(2). These motions are generally based on the retroactive reduction of status points.
